These Terms & Conditions (the “Terms”) govern your access to and use of the website operated under the brand Vyka Diamonds (the “Website”) and any purchase of products through the Website. The Website and related services are operated by Vyka Trading FZE LLC, a company incorporated in the United Arab Emirates (“Vyka”, “we”, “us”, “our”).
By accessing the Website or placing an order, you agree to be bound by these Terms.
1. Definitions
In these Terms:
- “Products” means jewellery and related items offered on the Website.
- “Custom-Made Products” means products made to your specifications or otherwise produced/assembled to order (including customised specifications such as selected stone/setting combinations, bespoke requests, or custom production).
- “Order” means a request by you to purchase Products.
- “You” or “your” means any user of the Website, including customers.
- “Policies” means any policies referenced on the Website (including the Privacy Policy, Returns Policy, and Delivery Policy, if published).
2. Country of Domicile
The United Arab Emirates is our country of domicile.
3. Eligibility, Minors and Use of the Website
You represent that you are at least 18 years old and legally able to enter into a binding contract.
Users who are minors / under the age of 18 shall not register as a user of the Website and shall not transact on or use the Website.
You agree not to misuse the Website, interfere with its operation, attempt unauthorised access, or use the Website for unlawful, fraudulent, or abusive purposes.
4. Account Registration and Confidentiality
If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for all activities carried out under your account. You must notify us immediately if you suspect any unauthorised use of your account.
5. Product Information and Availability
We endeavour to display Products accurately. However:
- Product imagery may vary due to lighting, photography, and screen settings.
- Minor variations in finish and appearance may occur consistent with jewellery manufacturing norms.
All Products are subject to availability. We reserve the right to withdraw, limit quantities, or discontinue Products at any time.
6. Pricing, Currency, Taxes and Duties
Prices are displayed in the currency shown at checkout.
We accept payments in AED. Prices may be inclusive or exclusive of VAT/taxes depending on your location and checkout configuration.
You are responsible for any customs duties, import taxes, clearance charges, or similar fees imposed by the destination country, unless we expressly confirm otherwise at checkout.
We reserve the right to correct pricing errors. If an Order is affected by a material error, we may cancel the Order and refund any amounts paid.
7. Payments (Visa and MasterCard)
We accept payment by Visa and MasterCard (and any additional methods displayed at checkout). Payments are processed through third-party payment service providers. We do not store full payment card details.
Cardholder must retain a copy of transaction records and Merchant policies and rules.
8. Sanctions and Restricted Jurisdictions
We will not trade with or provide any services to OFAC and sanctioned countries.
We may refuse, cancel, or suspend any Order or access to the Website where we reasonably believe doing so is necessary to comply with applicable sanctions, anti-money laundering, or regulatory requirements.
9. Orders and Acceptance
Submitting an Order constitutes an offer to purchase. An Order is accepted only when we:
- confirm the Order (including by email), and
- receive successful payment authorisation (or otherwise confirm payment arrangements).
We may refuse or cancel Orders, including where we reasonably suspect fraud, payment issues, stock unavailability, system errors, or pricing/description errors.
10. Shipping and Delivery
Shipping options and estimated delivery timelines are displayed at checkout. Delivery dates are estimates, not guarantees. We are not responsible for delays caused by couriers, customs clearance, inaccurate address details, or circumstances beyond our reasonable control.
Unless applicable law requires otherwise, risk of loss passes to you upon delivery to the address provided (or as recorded by the carrier).
11. Returns, Exchanges and Refunds
Return Window (Non-Custom Products): Eligible Products may be returned within 21 days of delivery (the “Return Window”), subject to our Policies and applicable law.
Custom-Made Products: Custom-Made Products are not eligible for refunds and may be final sale, except where required by applicable law (e.g., defective or non-conforming under mandatory consumer rights).
Returned Products must be in original condition, unworn, and unmodified, and capable of passing inspection by our quality team. Approved refunds will generally be issued to the original payment method, subject to payment provider rules.
12. Ring Sizes, Customisation and Customer Inputs
You are responsible for selecting accurate specifications, including ring size, metal type/colour, stone choice, engraving text, and delivery details. We are not liable for errors arising from incorrect information provided by you.
Where an Order is treated as a Custom-Made Product, you acknowledge it may be non-refundable as set out in Section 11.
13. Warranty and Care
Where a warranty is offered, the scope and conditions will be described on the Website or provided with your Order. Normal wear and tear, misuse, accidents, loss, and third-party repairs/modifications are not covered unless stated otherwise.
14. Intellectual Property
All content on the Website (including text, graphics, images, logos, designs, and layout) is owned by or licensed to Vyka and protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or exploit Website content without prior written consent.
15. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, special, or consequential losses (including loss of profits, revenue, or business opportunity).
- Our total liability for any claim relating to an Order or the Website is limited to the amount you paid for the relevant Order.
Nothing in these Terms limits liability that cannot be excluded under applicable law (including liability for fraud or wilful misconduct).
16. Indemnity
You agree to indemnify and hold us harmless against claims, damages, losses, and expenses arising from your breach of these Terms, misuse of the Website, or violation of applicable law.
17. Privacy
Your use of the Website is governed by our Privacy Policy, which forms part of these Terms by reference.
18. Governing Law and Jurisdiction
The governing law is the local law of the United Arab Emirates.
You agree that the courts of competent jurisdiction in the United Arab Emirates shall have jurisdiction, subject to any mandatory consumer protection rights that may apply in your country of residence.
19. Changes to These Terms
We may amend these Terms from time to time. Updated Terms will be posted on the Website with a revised Effective Date. Continued use of the Website after posting constitutes acceptance of the updated Terms.
